Partner Visa

1. Partner visa (temporary) onshore ( Subclass 820)

With this visa you can

  • stay in Australia until we decide your permanent Partner (Migrant) visa (subclass 801) or that application is withdrawn
  • work in Australia
  • study in Australia (you will not receive government support)
  • travel to and from Australia as many times as you want
  • attend up to 510 hours of free English language classes provided by the Adult Migrant English Program
  • enrol in Australia’s public health care scheme, Medicare

How long you can stay

Stay on the visa until we decide your permanent visa (subclass 801) application.

For most applicants, this stay is from 15 to 24 months.

Applicants who have been in a long term relationship before they apply might not have to stay on the subclass 820 visa at all. We might grant you the permanent visa immediately after we grant the temporary subclass 820 visa.

2. Partner visa (permanent) onshore ( Subclass 801)

With this visa you can

  • stay in Australia indefinitely
  • work in Australia
  • study in Australia
  • enrol in Australia’s public healthcare scheme, Medicare
  • sponsor your family members to come to Australia
  • travel to and from Australia for 5 years
  • if eligible, attend free English language classes provided by the Adult Migrant English Program
  • if eligible, apply for Australian citizenship

Travel to and from Australia for 5 years

You can travel to and from Australia as many times as you want for 5 years from the date we grant this visa. This is as long as the travel facility on this visa remains valid.

If you want to travel after the initial 5-year travel facility:

  • you will need to apply for and be granted a Resident Return (RRV) so that you can re-enter Australia as a permanent resident
  • you might also want to consider Australian citizenship. If you become an Australian citizen, you don’t require a visa to enter Australia. How long you can stay

This is a permanent visa. It lets you stay in Australia indefinitely.

You become a permanent resident on the day the visa is granted.

For citizenship purposes, your permanent residency starts:

  • on the day the visa is granted if you are in Australia
  • on the day you enter Australia on this visa if you are outside Australia.

3. Partner visa (temporary) offshore ( Subclass 309)

With this visa you can

  • stay in Australia until we decide your permanent Partner (Migrant) visa (subclass 100) or the application is withdrawn
  • work in Australia
  • study in Australia (you will not receive government support)
  • travel to and from Australia as many times as you want
  • attend up to 510 hours of free English language classes provided by the Adult Migrant English Program
  • enrol in Australia’s public health care scheme, Medicare

How long you can stay

Stay on the visa until we decide your permanent visa (subclass 100) application or you withdraw the application.

For most applicants, this stay is from 15 to 24 months.

In some circumstances, including where you have been in a long term relationship before you apply, you might not stay on the 309 visa at all. We might grant you the permanent visa immediately after we grant the temporary 309 visa.

4. Partner visa (Permanent) ( Subclass 100)

With this visa you can

  • stay in Australia indefinitely
  • work in Australia

  • sponsor your relatives to come to Australia
  • travel to and from Australia for 5 years
  • if eligible, attend free English language classes provided by the Adult Migrant English Program
  • if eligible, apply for Australian citizenship

Travel to and from Australia for 5 years

If you are outside Australia at the time of visa grant you must enter Australia before the date specified in your grant letter. The first entry date is generally set at 12 months from the date of visa grant.

You can travel to and from Australia as many times as you want for 5 years from the date we grant this visa. This is as long as the travel facility on this visa remains valid.

If you want to travel after the initial 5 year travel facility:

  • you will need to apply for and be granted a Resident Return (RRV) so that you can re-enter Australia as a permanent resident.

5. Prospective Marriage visa ( Subclass 300)

With this visa you can

  • stay in Australia for between 9 and 15 months from date of grant of visa
  • work in Australia
  • study in Australia at your own expense
  • travel to and from Australia as many times as you want

Partner visa

If we grant you this visa and you and your spouse want to settle in Australia, apply for a Partner visa (subclass 820 and 801):

  • after you are married, and
  • before your Prospective Marriage visa ends

You will pay less for the Partner visa if you apply for it while your Prospective Marriage visa is still valid.

How long you can stay

This is a temporary visa. You can stay in Australia for the period specified on the visa grant letter. This is between 9 and 15 months from the visa grant date.
